GENERAL TERMS
1. The 'customer' purchasing services from KYZIKOS TRAVEL agrees to abide by the rules listed below.
2. The customer is responsible for ensuring that the identified people accompanying them on the tour understand and accept these service sales rules and that they provide accurate information about these individuals, such as name, surname, and TC Identity number, to enable them to benefit from the service.
3. The customer must carry their identity card during the tour.
4. The customer accepts that all responsibility regarding their luggage and its contents lies with them; they are responsible for monitoring and controlling their belongings and that KYZIKOS TRAVEL or its employees bear no legal or criminal responsibility for any lost, stolen, or damaged items and will not file any claims against KYZIKOS TRAVEL or its employees for these reasons.
5. The customer is obliged to comply with the laws and customs to which the vehicle they will travel is subject, follow the rules informed by the guide, facilities, agency, tour staff, and transportation vehicle authorities regarding the purchased service, and not to endanger the safety of third parties. In case the safety of third parties is jeopardized, the customer will be personally and primarily liable for all resulting material or moral damages and agrees that KYZIKOS TRAVEL will not provide the service in this situation, and thus the customer has no right to a refund.
6. According to the Law No. 1618 on Travel Agencies, the selection of the establishments where breaks will be made is done by KYZIKOS TRAVEL or employees while considering customer interests. In cases of force majeure, a majority vote of the guests on the bus will be consulted.
7. The customer acknowledges that they will cover the costs of food, beverages, personal expenses, and all services not included in the defined service.
8. The museum card fee is not included in the tour fees, and the museum card is valid only at museums and archaeological sites under the Ministry of Culture and Tourism, and it is not valid at sites where capacity limitations might compromise the preservation of historical context due to excessive loading.
9. In tours prepared by KYZIKOS TRAVEL, seat numbers will be determined based on the order of reservations, and guests who do not participate in the current tour but cancel their reservation for front seats will have their vacant seats filled by guests from the back to the front. Requests for adjacent seating from groups will not change the seating arrangement of the group or be shifted forward in a way that disrupts their arrangement. For bookings of three or more with an odd number, the customer who must sit alone will be determined by KYZIKOS TRAVEL based on the gender of the participants. Such adjustments will be made at KYZIKOS TRAVEL's discretion without notifying guests about seat changes.
10. Guests who have registered for tours organized by KYZIKOS TRAVEL must keep the 'receipt of collection' provided for the payment they made, as those without the receipt will not be able to claim any rights for the tour fee they paid.
11. Guests who have preregistered for day trips must pay the tour fee to KYZIKOS TRAVEL at least 7 days before the tour date; otherwise, KYZIKOS TRAVEL reserves the right to cancel their preregistration without justification.
12. Guests who register for day trips and overnight tours accept that they will not receive a refund of the fee they paid if they wish to cancel their tour without providing a valid reason (beyond health reports, appointment documents, etc.).
13. In overnight and international tours organized by KYZIKOS TRAVEL, participants must make the preliminary payment as instructed by KYZIKOS TRAVEL staff to confirm the tour, and the total tour fee must be paid at least 30 days (1 month) prior to the tour date.
14. The customer may transfer the service to a third party who fulfills the conditions by informing in writing at least 7 days before the service begins. The 'transferee' is jointly responsible for all costs arising from the balance and the transfer.
15. In confirmed tours, guests agree to be present at the tour departure point at least 15 minutes prior to the scheduled departure time. KYZIKOS TRAVEL's personnel may proceed to start the tour without waiting for late guests in consideration of the inconvenience to other guests. Guests who have paid for the tour but cannot participate due to personal problems accept that KYZIKOS TRAVEL will not bear any legal or criminal responsibility and they waive any request for a refund or any right.
16. Tours will start and end at the points communicated to the guests. Guests may join the tour at the points designated by KYZIKOS TRAVEL along the travel route, and disembark at the points designated by KYZIKOS TRAVEL for the return.
17. In case of force majeure or unforeseen natural events affecting the tour program that cannot be avoided by the staff of KYZIKOS TRAVEL, changes to the tour program may be made at the discretion of KYZIKOS TRAVEL. Participants in the tour accept that KYZIKOS TRAVEL and its employees will bear no legal or criminal responsibility in this regard.
18. Guests providing contact information during registration accept that any difficulties arising from the inability to reach them will not be the personal issue of KYZIKOS TRAVEL and its employees, and therefore they will not be able to claim any rights against KYZIKOS TRAVEL or its employees. Guests are obliged to keep their contact information up to date.
19. Despite all due diligence by KYZIKOS TRAVEL, tour cancellations due to adverse weather, road obstacles, strikes, terrorism, fog, war risks, unforeseen technical issues, and all other force majeure events can lead to cancelation of the trip without regard to the time remaining until the tour date. Customers accept that no refunds will be made for tours that must be canceled due to force majeure. (Guests with valid documents, like health reports or appointment letters, will receive refunds.) Registrations for canceled tours may be transferred to a subsequent tour upon customer request, or the fee paid may be held in the KYZIKOS TRAVEL account pool. Guests who want to keep their fees in the account pool have the right to use this amount on any tour they desire at any time. In these situations, the customer will not have the right to compensation.
20. In all day trips and overnight tours organized by KYZIKOS TRAVEL, tours will be conducted using the vehicles deemed suitable by KYZIKOS TRAVEL depending on the route and program conditions.
